I’ll be honest: I’m not a lawyer, so I probably only caught about half of what went down in that courtroom. But even I could tell something was off.

Elon Musk’s legal team put Jared Birchall on the stand. You know Birchall — he’s Musk’s finance guy, the one who handles the messy money stuff and generally puts out fires. Most of his testimony was the kind of dry, procedural garbage that makes you grateful for a fast-forward button in real life. It felt like they were just trying to get certain documents into the record, which is boring but normal.

Then, right at the tail end of his direct examination, something genuinely unexpected happened. The lawyer asking the questions apparently made a move that nobody in the room saw coming. And I don’t mean a clever legal maneuver — I mean a potential self-own of epic proportions.

Birchall’s testimony suddenly veered into territory that seemed to undercut Musk’s own arguments. The details are still murky because the jury was out of the room at the time — this all happened during a sidebar or a closed session. But the vibe from the courtroom reporters was unmistakable: Musk’s team may have just handed Altman’s lawyers a gift.

The irony is thick. This trial has been framed as Musk vs. Altman, the clash of two egos in the AI arms race. But if Birchall’s testimony ends up damaging Musk’s case more than Altman’s, it’ll be a reminder that even billionaires can’t buy their way out of bad strategy.

I’ve seen this kind of thing before in high-stakes litigation — a witness who’s too close to the client, too eager to help, ends up saying something that can’t be walked back. Birchall is Musk’s guy through and through, and that loyalty might have backfired spectacularly.

We’ll have to wait for the transcripts to know for sure. But if I were on Musk’s legal team, I’d be having a very uncomfortable conversation right about now.
